Still no verdict on the Oudekraal case

Judgement was reserved on the Oudekraal case that came before the Supreme Court of Appeal on Tuesday.
Oudekraal owner Kassie Wiehahn asked the court to overturn a Cape High Court ruling that set aside the township development rights on a portion of his Oudekraal property on the slopes beneath the Twelve Apostles.

The development rights were granted over 50 years ago.

In 2007 the City of Cape Town applied successfully to the high court for this 1957 decision granting development rights to be reviewed and set aside. Wiehahn has asked the Supreme Court to overturn the decision.

The question about whether Wiehahn has rights to develop portion 7 of Oudekraal has been brought before court several times, and Wiehahn has lost each time.
